Terms of Service

Effective Date: March 30, 2026

These Terms of Service ("Terms") govern your use of the PodSips mobile application (the "App") operated by Paul Wakim ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 13 years old to use PodSips. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Description of Service

PodSips is a podcast listening application with an AI-powered chat feature. The App allows you to:

  • Stream and listen to podcast episodes.
  • Ask questions about podcast episodes and receive AI-generated answers based on episode transcripts.
  • Save podcasts to a personal library and track your listening history.
  • Manage your subscription and account settings.

3. Account Registration

To use PodSips, you must create an account by signing in with Apple or Google. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions and Payments

4.1 Subscription Plans

PodSips offers a free tier with limited features and paid subscription plans that unlock full access to AI chat capabilities. Current subscription options include monthly and annual plans. Pricing details are displayed in the App at the time of purchase.

4.2 Billing

All subscriptions are billed through Apple's App Store. By subscribing, you agree to Apple's terms of purchase. Payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period.

4.3 Free Trials

We may offer free trial periods for certain subscription plans. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee. Free trials are limited to one per Apple ID.

4.4 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until your current billing period ends. We do not provide refunds for partial billing periods. For refund requests, please contact Apple Support directly.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to gain unauthorized access to the App, other users' accounts, or our backend systems.
  • Reverse-engineer, decompile, or disassemble the App or any part of its underlying technology.
  • Use automated tools, bots, or scripts to access the App or extract data from it.
  • Interfere with or disrupt the operation of the App or the servers and networks used to make it available.
  • Circumvent or attempt to circumvent usage limits, subscription restrictions, or any other technical measures we implement.
  • Use the AI chat feature to generate content that is harmful, abusive, harassing, defamatory, or otherwise objectionable.
  • Redistribute, republish, or commercially exploit podcast content accessed through the App without authorization from the content owner.

6. AI-Generated Content

The App uses artificial intelligence to generate responses to your questions about podcast episodes. You acknowledge and agree that:

  • AI-generated responses are provided for informational and entertainment purposes only. They may be inaccurate, incomplete, or misleading.
  • You should not rely on AI-generated content as a substitute for professional advice, including but not limited to medical, legal, financial, or therapeutic advice.
  • We do not guarantee the accuracy, reliability, or completeness of any AI-generated content.
  • AI responses are based on podcast transcript data and may not reflect the most current information on a topic.

7. Podcast Content

PodSips provides access to podcast content created by third-party podcast creators. We do not own, produce, or endorse any podcast content available through the App. All podcast content remains the intellectual property of its respective creators and publishers. We are not responsible for the accuracy, quality, or appropriateness of any podcast content.

8. Intellectual Property

The PodSips App, including its design, code, features, logos, and trademarks, is owned by Paul Wakim and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, or create derivative works based on the App.

9. Account Deletion

You may delete your account at any time from the Profile screen in the App. When you delete your account, we permanently remove your personal data, chat history, library, and listening history from our servers. Active subscriptions must be cancelled separately through your Apple ID account settings, as we cannot cancel Apple subscriptions on your behalf.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the App ceases immediately.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Paul Wakim SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) ANY AI-GENERATED CONTENT PROVIDED THROUGH THE APP; (C) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; OR (D) ANY INTERRUPTION OR CESSATION OF SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold harmless Paul Wakim, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Denver County, Colorado.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
